VISTO, el expediente de inscripción de lista de candidatos para el Concejo Regional de Lima, Departamento de Lima, presentada por Ricardo Antonio Carreño Collantes, personero legal titular de la Organización Política “Concertación para el Desarrollo Regional – Lima”, para participar en las Elecciones Municipales 2014; y
- el presente caso se advierte que la solicitud de inscripción de la lista de candidatos presentada no cumple el siguiente requisito formal:
(i) Los candidatos a Consejeros Regionales Marianela Elena Rodriguez Gonzales y Lisbeth Esthefani Quispe Avalos no cuenta con el tiempo de residencia señalada en el artículo 13 LER la cual prescribe “En caso de que el DNI del candidato no acredite el tiempo de domicilio requerido, deberá presentar original o copia legalizada del o los documentos con fecha cierta, que acrediten los tres años del domicilio, en la circunscripción en la que se postula.
Los tres años de domicilio en la circunscripción a la que se postula podrán ser además acreditados, entre otros medios coadyuvantes, con originales o copias autenticadas de los siguientes instrumentos: a) Registro del Seguro Social; b)Recibos de pago por prestación de servicios públicos; c) Contrato de arrendamiento de bien inmueble; d) Contrato de trabajo o de servicios; e) Constancia de estudios presenciales; f) Constancia de pago de tributos; g)Título de propiedad del bien inmueble ubicado en el lugar en el que se postula”.
(ii) Que, del reporte del ROP se aprecia que el candidato a consejo regional Miguel Ángel Mufarech Nemy, se encuentra afiliado a la Organización Política PADIN – Movimiento Independiente Regional, y el candidato en mención no ha presentado documento sustentatorio de su renuncia hacia la organización política; tal como lo establece el Reglamento en su artículo 24 numeral 24.4 Ningún ciudadano afiliado a una organización política, que está inscrita en el ROP, podrá postular por otra organización política, a menos que hubiese renunciado a dicha afiliación hasta cinco meses antes de la fecha límite de presentación de la solicitud de inscripción de fórmula y lista de candidatos, o que su organización política lo autorice expresamente, siempre y cuando esta no presente solicitud de inscripción de fórmula y lista de candidatos en dicha circunscripción electoral.
(iii) Del candidato a Serafín Jaime Arteaga Huamanyauri no se encuentra inserto en el expediente su declaración jurada de vida, tal lo establece el Reglamento. “Al momento de solicitar la inscripción de la fórmula y lista de candidatos regionales ante el JEE, la organización política deberá adjuntar la impresión de la Declaración Jurada de Vida registrada en la página web institucional del JNE”.
El artículo 28, numeral 28.1, del Reglamento líneas precedentes dispone que las observaciones a las solicitudes de inscripción de listas de candidatos podrán subsanarse en un plazo de dos (2) días naturales.
Por tanto, el Pleno del Jurado Electoral Especial de Huaura en uso de sus atribuciones,
RESUELVE:
Artículo primero: Declarar INADMISIBLE la solicitud de inscripción de la lista de candidatos presentada por Ricardo Antonio Carreño Collantes, personero legal titular de la Organización Política “Concertación para el Desarrollo Regional – Lima”, con el objeto de participar en las Elecciones Municipales 2014; y en consecuencia, conceder un plazo de dos (2) días naturales para subsanar las observaciones indicadas, bajo apercibimiento de declarar improcedente la solicitud de inscripción.
Artículo segundo: NOTIFÍQUESE al personero legal de la organización política “Concentración para el Desarrollo Regional – Lima”, en el domicilio procesal señalado en su solicitud.
En el movimiento Fuerza Regional
VISTO el expediente de solicitud de inscripción de lista de candidatos para el Gobierno Regional de Lima, presentado por Carmelo Reynaldo García Flores, personero legal titular de la organización política “FUERZA REGIONAL” para participar en las Elecciones Regionales2014.
En el presente caso se advierte que la solicitud de inscripción de la lista de candidatos presentada no cumple los siguientes requisitos formales:
- De acuerdo a lo señalado por el artículo 26º inciso 2) del Reglamento de Inscripción de Listas de Candidatos para Elecciones Regionales, contenido en la Resolución Nº 272-2014-JNE, no ha cumplido el personero legal con firmar el acta de elecciones internas.
- Respecto del acta de elecciones internas, se advierte que en las actas de elecciones internas no se ha consignado la conformación de los comités electorales de elección de los candidatos, de acuerdo a lo establecido en el artículo 26° inciso 2) literal d, y cabe mencionar, que también se encuentra establecido en el Estatuto de la referida organización política, en su artículo 94°donde indica:
“Comité Electoral Regional, programará y ejecutará todas las etapas de los procesos electorales del movimiento, incluidas las convocatorias, la inscripción de los candidatos, el computo de los votos o la verificación del quórum de acuerdo al Estatuto, la proclamación de los ganadores y la resolución de las impugnaciones a las que hubiera lugar”.
Es preciso indicar que existen contradicciones en cuanto a la modalidad de elección de candidatos, se advierte del Acta de Asamblea General Regional Extraordinaria que la modalidad señalada es “Elecciones a través de los delegados elegidos por los órganos partidarios”, sin embargo en el Acta de Elecciones Internas de Candidatos a Consejeros Titular y Accesitario de Yauyos, se indica como modalidad de elecciones. “Elecciones con voto universal, libre, voluntario, igual, directo y secreto de los ciudadanos afiliados y no afiliados”. No estando esta última modalidad contemplada en el estatuto de la referida organización política. Por tanto, sírvase precisar la conformación de los comités electorales y la modalidad de las elecciones.
- Sobre los candidatos a consejeros regionales Julio Toledo Landa, Cesar Augusto Reyes Villanueva y Joselyn Rosa Coronado Vivar: De acuerdo a lo establecido en el artículo 22° inciso c) del Reglamento de Inscripción de Fórmulas y Listas de Candidatos para las Elecciones Regionales que señala:
“d.-Estar inscrito en el RENIEC con domicilio en dicha circunscripción. (…)”
En concordancia con el artículo 13° inciso 2) de la Ley de Elecciones Regionales que establece:
“2.- Acreditar residencia efectiva en la circunscripción en la que se postula y en la fecha de postulación, con un mínimo de tres años (03); y estar inscrito en el Registro Nacional de Identidad y Estado Civil (RENIEC) con domicilio en la circunscripción para la que postulas”.
Por tanto, se verifica de acuerdo a las copias adjuntadas de los documentos nacional de identidad, que el candidato a consejero regional titular por la provincia de Huaura, Sr. Julio Toledo Landa, se encuentra inscrito en el RENIEC con domicilio en el distrito de Supe, Provincia de Barranca. Asimismo, los candidatos a consejeros regionales titular y alterno por la provincia de Cajatambo, Sr Cesar Augusto Reyes Villanueva y Sra. Joselyn Rosa Coronado Vivar, ambos se encuentra inscritos en el Reniec con domicilio en la Provincia de Lima. Siendo un incumplimiento de un requisito de ley no subsanable.
El artículo 29º, inciso 1), del citado Reglamento antes señalado dispone que las observaciones a las solicitudes de inscripción de listas de candidatos podrán subsanarse en un plazo de dos (2) días naturales.
Por tanto, el Pleno del Jurado Electoral Especial en uso de sus atribuciones,
RESUELVE:
Artículo Primero: Declarar INADMISIBLE la solicitud de inscripción de la lista de candidatos al Gobierno Regional de Lima, presentado por Carmelo Reynaldo García Flores Sotelo, personero de la organización política “FUERZA REGIONAL”, para participar en las Elecciones Municipales 2014; en consecuencia, conceder un plazo de dos (2) días naturales para subsanar las observaciones indicadas en los considerandos primero y segundo, bajo apercibimiento de declarar improcedente dicha solicitud de inscripción.
Artículo Segundo.- Declarar IMPROCEDENTE las candidaturas de Julio Toledo Landa, Cesar Augusto Reyes Villanueva y Joselyn Rosa Coronado Vivar, quienes postulan respectivamente como candidatos a Consejero Regional Titular por la provincia de Huaura, y Consejero Regional Titular y Alterno por la Provincia de Cajatambo por la organización política “FUERZA REGIONAL”, quedando, en consecuencia, EXCLUIDOS de la lista de candidatos.
Unidad Cívica Lima
VISTO el expediente de solicitud de inscripción de lista de candidatos para el Gobierno Regional de Lima y el escrito de fecha 04 de julio último, presentado por Ramón Arístides Aldave Sotelo, personera legal titular de la organización política “UNIDAD CIVICA LIMA” para participar en las Elecciones Regionales2014.
En el presente caso se advierte que la solicitud de inscripción de la lista de candidatos presentada no cumple los siguientes requisitos formales:
- De acuerdo a lo señalado por el artículo 26º inciso 2) del Reglamento de Inscripción de Listas de Candidatos para Elecciones Regionales, contenido en la Resolución Nº 272-2014-JNE, no ha cumplido el personero legal con firmar el acta de elecciones internas.
- No se ha cumplido con presentar el impreso del Formato Resumen del Plan de Gobierno, tal como lo dispone el artículo 26 inciso 4) del Reglamento citado anteriormente.
- Sobre la candidata Flor Genoveva Cabrera Navidad e Ike Maximiliano Santos Suarez: De acuerdo a lo señalado por el artículo 26 numeral 10) del citado Reglamento que señala:
“En Caso de que el DNI del candidato no acredite el tiempo de residencia o domicilio requerido, deberá presentar original o copia legalizada de los documentos con fecha cierta, que acrediten los tres años de residencia efectiva en la circunscripción en la que se postula.
Las actividades propias de la residencia en la circunscripción a la que se postula podrán ser acreditadas por el periodo requerido, además entre otros medios coadyuvantes, con originales o copias autenticadas de los siguientes instrumentos: a) Registro del Seguro Social; b) Recibos de Pago por Prestación de Servicios Públicos; c) Contrato de Arrendamiento de Bien Inmueble; d) Contrato de Trabajo o de Servicios; e) Constancia de Estudios Presenciales; f) Constancia de Pago de Tributos; y g) Título de Propiedad de bien inmueble ubicado en el lugar en que se postula”.
En el presente caso, conforme a la base de datos del Registro de Identificación y Estado Civil, que los candidatos no cumplen con acreditar el tiempo de residencia efectiva, por lo que deberán adjuntar los documentos en original o copia legalizada, de fecha cierta que acredite el tiempo de residencia efectiva en la circunscripción que postulan.
- Respecto de la candidata Kimberling Jhanina Osorio Alvarado, no ha cumplido con adjuntar copia simple de su documento nacional de identidad.
El artículo 29º, inciso 1), del citado Reglamento antes señalado dispone que las observaciones a las solicitudes de inscripción de listas de candidatos podrán subsanarse en un plazo de dos (2) días naturales.
Por tanto, el Pleno del Jurado Electoral Especial en uso de sus atribuciones,
RESUELVE:

VISTO el expediente de solicitud de inscripción de lista de candidatos para el Gobierno Regional de Lima, presentado por Edivio Carlos Papa Sanchez, personero legal titular de la organización política “FUERZA POPULAR” para participar en las Elecciones Regionales2014.
En el presente caso se advierte que la solicitud de inscripción de la lista de candidatos presentada no cumple los siguientes requisitos formales:
- Se advierte de la verificación a la solicitud de inscripción de lista para el gobierno regional, que no se ha adjuntado el documento nacional de identidad de los candidatos Javier Luis Chumbi Astocahuana y Elizabeth Hijar Mendoza, conforme señala el artículo 26° inciso 13 del citado reglamento.
El artículo 29º, inciso 1), del citado Reglamento antes señalado dispone que las observaciones a las solicitudes de inscripción de listas de candidatos podrán subsanarse en un plazo de dos (2) días naturales.
Por tanto, el Pleno del Jurado Electoral Especial en uso de sus atribuciones,
RESUELVE:

VISTO el expediente de solicitud de inscripción de lista de candidatos para el Gobierno Regional de Lima, presentado por Rogger Abel Taboada Rodriguez, personero legal titular de la organización política “SIEMPRE UNIDOS” para participar en las Elecciones Regionales2014.
En el presente caso se advierte que la solicitud de inscripción de la lista de candidatos presentada no cumple los siguientes requisitos formales:
- Respecto de la candidata Doris Yolfa Anaya Anaya, de la verificación del registro de organizaciones políticas se verifica que dicha candidata se encuentra afiliada al partido nacionalista peruano, cumpla con presentar su renuncia o autorización para postular, conforme señala el artículo 26° inciso 12) del citado reglamento
- Respecto de la candidata Irene Lucia Suarez Salsavilca, conforme se aprecia del sistema de información de procesos electorales y de la fecha de emisión de su documento nacional de identidad, si bien se adjunta un certificado domiciliario y el acta de nacimiento, estos documentos acreditan la procedencia y el domicilio actual de la referida candidata pero no acreditan el tiempo de residencia efectivo que señala el artículo 13° de la ley de elecciones regionales.
El artículo 29º, inciso 1), del citado Reglamento antes señalado dispone que las observaciones a las solicitudes de inscripción de listas de candidatos podrán subsanarse en un plazo de dos (2) días naturales.
Por tanto, el Pleno del Jurado Electoral Especial en uso de sus atribuciones,

- Respecto de la candidata Noemí Justina Liberato Chavarría, conforme al artículo 26º inciso 10) del Reglamento de Inscripción de Listas de Candidatos para Elecciones Regionales, contenido en la Resolución Nº 272-2014-JNE, que señala:
“En caso de que el DNI del candidato no acredite el tiempo de residencia o domicilio requerido, deberá presentar original o copia legalizada de los documentos con fecha cierta, que acrediten los tres años de residencia efectiva en la circunscripción en la que se postular.
